Welcome to 239 Smart LLC. These Terms of Service ("Terms") govern your use of this website and any services offered by 239 Smart LLC. By accessing this site, submitting a service request, or engaging 239 Smart LLC for services, you agree to be bound by these Terms.

1. General

239 Smart LLC provides smart home installation and home services in Southwest Florida. By using this website or requesting service, you confirm that you are at least 18 years of age and legally capable of entering into a binding contract.

2. Services

This website does not offer products for online purchase. Requests submitted through this site are requests for a service appointment, not an order. Service availability, scheduling, and pricing are provided directly by 239 Smart LLC and are subject to change without notice.

All prices quoted for services or products are in USD and are subject to change at the discretion of 239 Smart LLC until confirmed in writing for a specific job.

3. Products Supplied During Service

Where a job requires equipment or devices, 239 Smart LLC purchases and supplies those products on behalf of the customer as part of the service. Because each product is purchased to order for a specific customer and job, all products supplied by 239 Smart LLC are non refundable, whether or not installation has taken place. This does not affect any applicable manufacturer warranty on the device itself.

4. Workmanship Warranty

Installation services include a 30 day warranty covering workmanship and technical issues arising from the installation itself. This warranty does not cover manufacturer defects, which are handled under the applicable manufacturer warranty, nor issues arising from misuse, unauthorized modification, water damage, power surges, or service performed by another party after installation.

5. Intellectual Property

All content on this site, including images, logos, text, and code, is the property of 239 Smart LLC and may not be used or reproduced without prior written permission.

6. Limitation of Liability

To the fullest extent permitted by Florida law, 239 Smart LLC shall not be liable for any indirect, incidental, or consequential damages arising from use of this website or its services, including but not limited to installation errors, system malfunctions, or misuse of smart devices. Nothing in this section limits liability that cannot be excluded under applicable law.

Use of this site is also governed by the 239 Smart LLC Privacy Policy, which describes how customer information is collected, used, and protected.

8. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from these Terms or use of this website shall be brought exclusively in the state or federal courts located in Collier County, Florida.

9. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
